Approved Building Materials Specifications & Non-Compliance

**UPDATE** (10/15/2012)
The Billtown Farms HOA Board of Directors are happy to report that on August 9, 2012 the number of non-compliant homeowners was decreased by one (1), leaving only one (1) non-compliant homeowner in regards to the color of materials (roof shingles) used for repairs to their home. Your HOA Board has been diligent in its efforts to protect each homeowner's investment, property value and rights. Since the Law upheld the enforcement of Billtown Farms' Deed Restrictions, and to further the Board's efforts of investment-protection, the HOA's attorney has been instructed to increase efforts in reducing the number of non-compliant homeowners in Billtown Farms to zero.

 
Please contact the Board as soon as possible if you are concerned because:
  1) You have not completed/submitted a "Color Modifications: Approval Request Form"
and/or
  2) Repairs have already been made and the color(s) and/or specifications of the materials used for
       your, OR a neighbors, home are non-compliant.
 
PLEASE NOTE:
 
The Billtown Farms HOA provided EVERY homeowner a hard-copy version of the "Approved Materials & Colors for Building Materials", which specifies the approved colors and material types that are allowed to be installed on homes in Billtown Farms, along with the "Color Modifications: Approval Request Form", which is to be completed and submitted to the HOA Board by EVERY homeowner PRIOR to any repairs being made.  Each homeowner received these documents via United States Postal Service's First Class Mail and have been, and will continue to be, available here on the Billtown Farms website. **Click on the bold, underlined hyperlinks above to be taken to the forms.**
 
For those homeowners who do NOT comply with these specifications, the Billtown Farms Homeowners Association Board of Director WILL SEEK LITIGATION.
 
**SEE UPDATED INFORMATION ABOVE** (10/15/2012)
Unfortunately, as of today (6/11/2012) the Billtown Farms HOA has instructed its attorneys to begin litigation proceedings against two (2) homeowners in Billtown Farms. These individuals have willfully refused to submit the required repair approval forms and have had non-approved materials installed on their homes.
 
The HOA Board is requesting, but not limited to, the following:
  1. Monetary settlement (yet to be determined) that will include attorney fees,  management company-assessed fees, violation fines, lost wages (time Board Members have to spend away from their jobs handling issues related), and more. 
  2. Homeowner remove non-approved materials from their home
  3. Homeowner complete and submit to the HOA Board and Design Review Board the required "Color Modifications: Approval Request Form"
  4. Homeowner contract with a vendor to install materials that are within the guidelines of the "Approved Materials & Colors for Building Materials" document
  5. Homeowner contact the Billtown Farms HOA and schedule an on-site inspection upon completion of work
In the event that liens are assessed against a homeowner not in compliance, the lien amount (which will be collected at time of closing in the event  title/ownership of the property is sold or transferred; or if the mortgage is refinanced) will include, but is not limited to, the following:
  1. All monetary items listed above
  2. Cost of removal of non-approved building materials (amount to be determined)
  3. Cost of approved building materials (amount to be determined)                  **colors used will be those selected by the original homeowner/developer  prior to the home being constructed and listed on the Design Consultation sheet                                                                                                                             **Homeowners wanting a copy of their current materials and colors, please send an email by clicking hoarequests@billtownfarms.com and it will be provided within 72 hours
  4. Cost of any additional legal and/or administrative fees related to filing and enforcing said lien
Thank you to all whom have complied with the repair process thus far and if you are aware of any neighbor that has installed, or is planning to install, non-approved materials, please do not hesitate contacting the HOA Board and/or our management company, Bill Stout Properties, as soon as possible.  Also, be sure to ask your neighbors if they have submitted their approval requests and direct them to this website.
